Terms of Service

These Terms and Conditions (“Terms”) govern your access to and use of the StandMetrics website,
mobile application, and related services (collectively, the “Services”), operated by
IEQ Technology, Inc. (“IEQ Technology,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction,
to use the Services. By using the Services, you represent that you meet this requirement
and that you have the authority to accept these Terms.
2. Description of Services
StandMetrics is a professional timber cruising and stand management platform designed to help users
capture field data, perform yield and value calculations, organize stand information, and export data.
Features may change from time to time without notice.
3. Account and Access
Certain features may require you to create an account or provide access credentials.
You are responsible for maintaining the confidentiality of your login information and for all activities
that occur under your account. You agree to notify us promptly of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful, fraudulent, or unauthorized purpose;
- Interfere with or disrupt the Services or servers;
- Attempt to gain unauthorized access to the Services or related systems;
- Reverse engineer, decompile, or otherwise attempt to extract source code, except where prohibited by law;
- Upload or transmit malicious code, viruses, or harmful content;
- Use the Services in a way that could damage, disable, or impair functionality for others.
5. User Data
You retain ownership of the field data, project information, and other content you enter into StandMetrics
(“User Data”). You grant IEQ Technology a limited, non-exclusive, revocable license to host, process,
transmit, back up, and display User Data solely as necessary to operate, maintain, and support the Services.
You are responsible for the accuracy, legality, and appropriateness of your User Data and for maintaining
any backups you consider necessary.
6. Offline Features, Sync, and Exports
Some features of the Services may work offline and may store information locally on your device.
If sync, export, support, or related cloud-enabled functions are used, certain User Data may be transmitted
or processed as needed to provide those functions.
7. Fees and Payments
Paid features, subscriptions, one-time purchases, or app marketplace purchases may be offered from time to time.
All pricing is subject to change. Unless otherwise stated, fees are non-refundable except as required by law
or applicable app marketplace rules.
8. Intellectual Property
The Services, including all software, design, branding, text, graphics, logos, and other content
provided by IEQ Technology, are owned by or licensed to IEQ Technology and are protected by intellectual
property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.
9. Feedback
If you provide suggestions, ideas, or feedback about the Services, you grant IEQ Technology the right to use,
modify, and incorporate that feedback without restriction or compensation to you.
10. Third-Party Services
The Services may interact with third-party platforms, app stores, mapping tools, export formats,
hosting providers, or other services. IEQ Technology is not responsible for third-party services,
their availability, or their terms and practices.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND,
WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
IEQ Technology does not warrant that the Services will be uninterrupted, error-free, secure,
or that calculations, estimates, exports, or outputs will always be complete, current, or accurate for your use case.
You are responsible for independently verifying results before relying on them for business, forestry, valuation,
compliance, or operational decisions.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IEQ TECHNOLOGY, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES,
AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION,
ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IEQ TECHNOLOGY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR
RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO IEQ TECHNOLOGY FOR
THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50.00).
13. Indemnification
You agree to defend, indemnify, and hold harmless IEQ Technology, Inc. and its affiliates, officers,
directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses
arising out of or related to your User Data, your misuse of the Services, or your violation of these Terms.
14. Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without notice,
if we believe you have violated these Terms, created risk for us or others, or where required
for operational, legal, or security reasons.
15. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal
courts located in Oregon, and you consent to the jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version on this page
and update the Effective Date above. Your continued use of the Services after revised Terms are posted
constitutes your acceptance of the updated Terms.

mobile application, and related services (collectively, the “Services”).

and services operated by IEQ Technology, Inc.

2.1 Information You Provide Through the Website or Support Channels
If you contact us by email, request support, or otherwise communicate with us, we may receive information
such as your name, email address, organization, and the contents of your message or attachments.
2.2 Information in the App
StandMetrics is designed so that we do not collect personal information from users through
the app for advertising, analytics profiling, or sale to third parties.
Data you enter into the app, such as stand, tree, plot, waypoint, pricing, or export-related project data,
is intended to be used to provide the app’s core functionality. Depending on the features you use, that data
may be stored locally on your device and may be transmitted or processed only as necessary to provide syncing,
backup, export, technical support, security, or other core service functions you choose to use.
2.3 Automatically Collected Technical Data
Our website or service providers may automatically receive limited technical data necessary to operate,
secure, and maintain the Services, such as IP address, browser type, device type, operating system,
basic server logs, and timestamps.
3. How We Use Information
We may use information we receive to:
- Provide, operate, maintain, and improve the Services;
- Respond to support requests and communicate with you;
- Enable syncing, exports, backups, and service functionality;
- Monitor security, prevent fraud, abuse, and technical issues;
- Comply with legal obligations and enforce our terms.
4. What We Do Not Do
- We do not sell your personal information.
- We do not use in-app personal information for third-party advertising.
- We do not collect personal information through the app for behavioral ad targeting.
5. Cookies and Similar Technologies
The StandMetrics website may use essential cookies or similar technologies required for basic website operation,
security, or performance. You can control cookies through your browser settings, though doing so may affect
website functionality.
6. Sharing of Information
We may share information only in the following circumstances:

StandMetrics does not sell personal information.
